On June 26, 2024, Los Angeles Superior Court Judge Barbara A. Meiers awarded attorneys’ fees against the Thoroughbred Owners of California (TOC) in the amount of Ten-Thousand, Eight-Hundred ($10,800.00) Dollars for improperly withholding its Membership list from long-standing TOC Member, Jerry Jamgotchian. Jamgotchian sought this Membership List to inform all fellow TOC members that the $162 Per Start Fee being charged to all horse owners is not their obligation to pay and is actually a fee charged solely to the Trainers who are obligated under CHRB Rule 1501 to provide Workman's Compensation Insurance for the Jockey whom they employ.
Pasadena-based attorney, Darren M. Salvin, owner and managing partner of the SALVIN LAW FIRM, APC that successfully litigated this case, stated after the ruling that, “We are happy that Judge Meiers supported our legal arguments and forced the TOC to finally release the Membership List to my client after they steadfastly refused to produce it. The release of this list was very important because all TOC members should be advised, and our client has the express right to so advise them, that they do not have any legal obligation to pay any Per Start Fee in California absent a change in the law. Our firm will continue to work hard to stop the improper collection of any Per Start Fees and save all California horse owners over $3,000,000 annually from these improperly charged Per Start Fees.”
